Carefully read the terms of use (“Terms of Use”) before using the Brotiket platform and services offered by Brotiket or third-party operators (“Operators”) through the Brotiket platform (“Services”). “You” when used in the Terms of Use refers to (1) anyone accessing the Brotiket platform and (2) the person for whom the Service is purchased by you. Changes to Terms of Use Modifications by Brotiket At its own discretion, Brotiket has the right to change or modify any part of these Terms of Use at any time, without prior notice. Visit this page regularly to review the binding Terms of Use. If there are changes or modifications to these Terms of Use, Brotiket will post the changes or modifications to these Terms of Use on this page by listing the last revision date of these Terms of Use at the bottom of the page. You are deemed to have accepted the revised Terms of Use if you continue to use the Brotiket platform after such changes or modifications. Do not use or access or continue to use or access the Brotiket platform and/or Services if you do not agree to the revised version of the Terms of Use. Check the Brotiket platform regularly for changes to the Terms of Use and to review these changes. In addition, when using the Services, you must abide by the additional terms applicable to the Services that may be posted on the related page of the Services from time to time, as well as the privacy policy imposed by Brotiket from time to time (“Privacy Policy”). All of these terms are an inseparable part of these Terms of Use. Access and Use of Services Ownership of Content This Brotiket platform, domain name (www.Brotiket.com), subdomains, features, content, and application services (including but not limited to any mobile application services) offered periodically by Brotiket in connection therewith are owned and operated by Brotiket. Provision and Accessibility of Services In accordance with these Terms of Use, Brotiket may offer the provision of Services on its own behalf or on behalf of the Operator, as more specifically described on the Brotiket Platform. The Services you have chosen on the Brotiket Platform are solely for your personal use and not for use by or on behalf of any third party. The term “Services” includes but is not limited to the use of the Brotiket Platform, any Services offered by Brotiket on its own behalf or on behalf of the Operator on the Brotiket Platform. Brotiket may change, suspend, or discontinue any Services, including the availability of features, databases, or content, at any time. Brotiket may also impose limitations or requirements on certain Services or limit your access to part or all of the Services without notice or obligation. Brotiket does not guarantee that the Services will always be available or uninterrupted. Brotiket has no responsibility to you if, for any reason, the Services are not available at any time or for any period of time. You are responsible for all matters necessary to access the Services. You are also responsible for ensuring that all persons accessing the Services through the Internet connection are aware of and comply with these Terms of Use and any other applicable Service terms and conditions. If you link to the Brotiket Platform, Brotiket may revoke your linking rights at any time at its discretion. Brotiket reserves the right to require written consent prior to linking to the Brotiket Platform. Brotiket Platform and Content Content Usage All material displayed or run on the Brotiket Platform, including but not limited to text, data, graphics, articles, photos, images, illustrations, videos, audio, and other material (“Content”) is protected by copyright and/or other intellectual property rights. The Brotiket Platform and its Content are intended solely for the personal and non-commercial use of the Service and may only be used in accordance with these Terms of Use. If Brotiket grants you access to the Brotiket Platform and/or Content, such access is a non-exclusive, non-transferable, and limited license to access the Brotiket Platform in accordance with these Terms of Use. At its discretion, Brotiket may at any time and without prior notice to you, change or remove or replace the presentation, substance, or functionality of any or all Content on the Brotiket Platform. You must comply with all copyright notices, trademark rules, information, and restrictions contained in the Brotiket Platform and Content accessed through the Brotiket Platform. You are prohibited from using, copying, reproducing, modifying, translating, publishing, broadcasting, transmitting, distributing, running, uploading, displaying, licensing, selling, or exploiting the Brotiket Platform or Content or any third party or other proprietary postings for any purpose, without prior written permission from the respective owners, or in any way that infringes on the rights of any third party. Brotiket’s Obligations for the Brotiket Platform and Content Brotiket cannot guarantee the identity of other users who may interact with you while you use the Brotiket Platform. Brotiket cannot guarantee the authenticity and accuracy of any content, material, or information that may be provided by other users or operators. All Content you access using the Brotiket Platform is at your own risk and you will be fully responsible for any damage or loss suffered by any party as a result of such access. In any event, Brotiket will not be liable in any way for Content, including but not limited to errors or omissions in Content, or any form of loss or damage arising in connection with the use or disclosure of any Content posted, transmitted via email, accessed, transmitted, or made available through the Brotiket Platform. Intellectual Property Rights Intellectual Property All intellectual property rights in connection with the Brotiket Platform belong to Brotiket or have been licensed to Brotiket for use on the Brotiket Platform. The Brotiket Platform, Services, and Content are protected by copyright and other intellectual property rights as a collective work and/or compilation, in accordance with copyright law, international conventions, and other applicable intellectual property laws. You promise that: (a) you will not modify, publish, transmit, participate in the transfer or sale, reproduce, create derivative works based on, distribute, perform, display, or in any way exploit any part of the Brotiket Platform and Content, software, material, or Services as a whole or in part; (b) you may only download or copy the Content (and other items displayed on the Brotiket Platform or related to the Services) solely for your personal and non-commercial use, subject to the condition that you retain all copyright and other proprietary notices contained in the Content; and (c) you are prohibited from storing any part of the Content in any form. Copying or storing any Content other than for personal and non-commercial use is strictly prohibited, unless prior written permission has been obtained from Brotiket or the copyright holder named in the relevant copyright notice of the Content. Confirmation of Booking, Ticket, Voucher, Rate, and Payment Booking Confirmation Bookings for some services must be confirmed immediately. For other services, the confirmation time listed on the Brotiket platform is only a reference. The actual time required for confirmation may vary. Purchase and Use of Voucher Through the Brotiket platform, you can purchase vouchers from Brotiket for services (“Vouchers”) offered by operators in various destinations. Subject to the policies of the relevant operator, you will receive a confirmation email of your purchase, which contains the voucher confirmation number (“Confirmation Number”) and a printable version of the voucher. To use the voucher, you must arrive on time at the meeting place designated by the relevant operator. You must also provide the operator with any necessary documents and/or information, including the Confirmation Number and/or printed voucher. If you fail to arrive on time or cannot provide the required documents or information, you will not receive a refund. To use the voucher, the operator may also require you to provide photo identification. Brotiket or the operator is not responsible for lost, damaged, or stolen vouchers or Confirmation Numbers. The voucher will be cancelled if the associated service is prohibited by law. If you attempt to use the voucher in a manner that is illegal (e.g., you are underage for drinking alcohol but try to use the voucher to taste wine), the relevant operator may reject the voucher and will not return your money. Voucher Terms The Terms of Use for each voucher may vary between operators. Restrictions on voucher usage, including but not limited to age requirements, will be communicated to you at the time of purchase on the Brotiket platform. The voucher is a one-time admission ticket to an event (‘Event’): the voucher usage date will be stated on the voucher. If the voucher is not used on or before the date stated on the voucher, unless explicitly stated on the voucher, you will not receive a refund. Cancellation of Voucher You can cancel the voucher by contacting Brotiket customer service during the cancellation period, as stated at the time of purchase on the Brotiket platform. The cancellation period may vary depending on the situation. The money spent on the cancelled voucher with the necessary notice will be fully refunded to the credit card you used to purchase the voucher. The operator, not Brotiket, is the party offering services for the event associated with the voucher. The operator is also fully responsible for accepting or rejecting the voucher you purchased for all related services. Member Brotiket Member Brotiket Member Points are given for activities purchased from the Brotiket platform, which are actually followed and without a refund, the points will be converted to Indonesian Rupiah currency and will be notified to the member’s email. Brotiket Points can be obtained in the following ways and the amount of Brotiket Points received may vary for each purchase, depending on Brotiket’s policy: (a) a reduction from product purchases; All Brotiket Points, regardless of the date obtained, will expire in 90 days counting from the last Qualifying Transaction Point Brotiket. “Qualifying Point Brotiket Transaction” includes the purchase of any services from the Brotiket platform that is not refunded, as well as other activities that generate Brotiket Points, such as giving reviews for certain services. If a refund is requested for a purchase, then the Brotiket Points will be adjusted. Brotiket Points will be valid for 90 days counting from the last Qualifying Point Brotiket Transaction performed. All expired Brotiket Points will become void and cannot be reactivated. Order and delivery rates and fees do not qualify for obtaining Brotiket Points. Brotiket Points cannot also be used to redeem or reduce order and delivery rates and fees. Brotiket Coupon Brotiket Coupon is a one-time use coupon and will not be returned after use. Brotiket Coupon can be used as a substitute for a discount on the Brotiket Booking Platform. To avoid doubt, after you use the Brotiket Coupon on the Brotiket Booking Platform, the Brotiket Coupon will not be returned or refunded, whatever the situation may be. Brotiket Points can be obtained in the following ways: (a) You can receive a Brotiket Coupon through the Brotiket Member Program, you can receive a Brotiket Coupon by contacting the Brotiket customer service. Misuse of Discount If Brotiket becomes aware that the Brotiket Points or Brotiket Coupons were obtained through fraud, in a manner that violates these Terms of Use, or in any other way not authorized by Brotiket, then Brotiket is entitled to take the following actions: (a) Immediately terminate your Brotiket Member; or (b) Cancel all Brotiket Points or Brotiket Coupons accumulated previously; or (c) Refuse to provide Services to you; or (d) Take any other action deemed appropriate based on Brotiket’s sole discretion. Brotiket Referral Program Program On certain Brotiket Sites, Brotiket may offer the opportunity for members to receive Brotiket Coupons by inviting their friends to become members of the Brotiket Site. Further, those friends must make a confirmed booking through the official Brotiket invitation channel (“Official Brotiket Channel”) (e.g. invitation sent through the Brotiket Platform, Facebook, or other social media channels supported by Brotiket). Terms You may only receive Brotiket Coupons through the official member invitation mechanism. Referrals made without the use of the Official Brotiket Channel will not result in the receipt of Brotiket Coupons. You understand that Brotiket Coupons are non-transferable, non-auctionable, non-exchangeable, non-saleable, and cannot be combined with coupons from other members. You agree that having multiple Brotiket Accounts is a violation of these Terms of Use. Additionally, sending invitations to alternative email addresses or attempting to circumvent the Brotiket Coupon Program system, without limiting other rights or remedial efforts of Brotiket, may result in the revocation of your membership and the loss of all Coupons in your Brotiket Account. You are prohibited from conducting self-promotion in connection with the Brotiket Coupon Program. You are prohibited from engaging in promotional, marketing, or other advertising activities on behalf of Brotiket, including the use of Brotiket trademarks. Brotiket reserves the right to cancel referrals and Brotiket Coupons if it suspects that the referral or Brotiket Coupon was obtained through fraud, in violation of these Terms of Use, or otherwise not authorized by Brotiket. The Brotiket Coupon Program is void where prohibited by law. Brotiket reserves the right to modify or terminate the Brotiket Coupon Program at any time. If there are any tax obligations associated with the accumulation and/or use of Brotiket Coupons, such taxes will be the sole responsibility of the participant. Privacy Policy Brotiket Privacy Policy To understand Brotiket’s policy regarding the use of your personal data, read the latest Brotiket Privacy Policy which is an integral part of these Terms of Use. Your acceptance of these Terms of Use is considered as acceptance and agreement to be bound by our Privacy Policy. Indemnification Indemnification for Brotiket You will indemnify and hold harmless Brotiket, its parent company, subsidiaries, affiliates, officers, directors, and employees from, including but not limited to, all losses, liabilities, settlements, costs, and attorney fees, claims or demands made by a third party arising from or arising from accessing the Brotiket Platform, using the Brotiket Platform, violating these Terms of Use, or violating intellectual property or other rights of others. Brotiket Involvement Brotiket may, if necessary, participate in the defense against any claims or actions and in negotiations for the settlement process. You are prohibited from settling any claims that may negatively impact Brotiket’s rights or obligations without prior written consent from Brotiket. Brotiket has the right, at its own expense and with notice to you, to defend and control exclusive control over any claims or actions. Disclaimers and Limitation of Liability Party Relationships Brotiket has no special relationship with you, and has no fiduciary obligation to you, to access and use the Brotiket Platform and Content. You acknowledge that Brotiket has no control over, and is not obligated to take any action with respect to: (a) Users who access the Platform Brotiket; (b) Content that you access through the Brotiket Platform; (c) The impact you may receive from Content; (d) The way you interpret or use Content; and (e) The actions you may take as a result of exposure to Content. Services and Comments You acknowledge and agree that the Operator may offer Services on the Brotiket Platform, and that such suggestions or recommendations may be provided by the Operator or Users of the Brotiket Platform. Brotiket makes no representations or warranties as to the accuracy of the descriptions in any part of the Services. Brotiket also makes no representations or warranties regarding the suggestions or recommendations for Services offered or purchased through the Brotiket Platform. Exemption from Obligation Under any circumstances, Brotiket, the Brotiket Platform, or its parent company, subsidiaries, affiliates, officers, directors, and/or employees of Brotiket will not be liable for any loss of profits or indirect, consequential, special, incidental, or punitive damages arising from, based on, or caused by: (a) the Brotiket Platform; or (b) these User Terms; or (c) any violation of these User Terms by you or a third party; or (d) the use of the Brotiket Platform, equipment, or Services we provide related to our business on the Brotiket Platform by you or a third party; or (e) any form of communication or transaction that occurs or is attempted between users, in any case, even if we have been informed of the possibility of such damages. Such limitations and exclusions apply regardless of whether the damages arise from: (a) breach of contract; or (b) breach of warranty; or (c) strict liability; or (d) a claim; or (e) negligence; or (f) other causes of action, to the extent such exclusions and limitations are not prohibited by applicable law. The Brotiket Platform, including all content, software, functions, materials, and information available on or accessed through the Brotiket Platform, is provided “as is”. To the extent permitted by applicable law, Brotiket makes no representations or warranties of any kind, express or implied, including but not limited to the content on the Brotiket Platform or material, information, and functions accessible through the Brotiket Platform, the Services or any hypertext links to third parties, or the security of sensitive information transmitted through the Brotiket Platform, or the ability of the Operator, the suitability for a particular purpose, the absence of infringement, or that the use of the Services will be free of interruption or errors. You agree and acknowledge that transmissions to and from the Brotiket Platform are not confidential and that your communications may be read or intercepted by others. Furthermore, you accept and agree that by sending communications to Brotiket and posting information on the Brotiket Platform, including tours and/or activities, no confidential, fiduciary, implied-in-fact or other relationship is created between you and Brotiket other than as expressly set forth in these Terms of Use. You agree and acknowledge not to seek or attempt to seek from Brotiket responsibility for the content provided by Operators or third parties. Furthermore, you accept and agree that Brotiket is not involved in any transactions related to the Services provided by any Operators or third parties. Brotiket has no control over and does not guarantee the security of any transactions, tours, and/or activities, or the truth or accuracy of any catalog or other content provided by any Operators or third parties on the Brotiket Platform. Legal Remedies If you are dissatisfied with the Brotiket Platform, do not agree to any part of these Terms of Use. Additionally, in the event of any dispute or claim against or involving Brotiket or any other users of the Brotiket Platform related to these Terms of Use or the Brotiket Platform, your sole remedy shall be to discontinue using the Brotiket Platform. Interactions with Third Parties Links to Third Party Websites The Brotiket platform may contain links to third-party websites or services (“Third Party Websites”) that are not owned or controlled by Brotiket, or Services may be accessed by logging in through Third Party Websites. Links to Third Party Websites are not support or recommendations of Brotiket to those Third Party Websites, or of the information, products, advertisements or other materials available on those Third Party Websites. You access Third Party Websites at your own risk. By doing so, you represent and warrant that you have read and agreed to be bound by all policies applicable to such Third Party Websites with respect to your use of the Services. You will also act in accordance with such policies, in addition to your obligations under these Terms of Use. Brotiket has no control and is not responsible for the content, accuracy, privacy policies, performance, or opinions expressed on any Third Party Websites. Furthermore, Brotiket will not and cannot monitor, verify, censor, or edit the content of any Third Party Websites. By using the Services, you explicitly release and relieve Brotiket from any and all obligations arising from your use of any Third Party Websites. Interactions between you and organizations and/or individuals found on or through the Services, including but not limited to Operators, including payment and delivery of goods or services, and any related terms, conditions, warranties, or statements, are solely between you and such organizations and/or individuals. Please conduct appropriate research before proceeding with online or offline transactions with third parties above. Brotiket’s Responsibility You agree that Brotiket is not responsible or liable for any loss or damage caused by such transactions. If there is a dispute among participants on this site, or between users and third parties, you understand and agree that Brotiket is not obliged to get involved in it. If you are involved in a dispute with one or more users or third parties, you hereby release Brotiket, its parent company, subsidiaries, officers, directors, employees, agents, and successors from any claims, demands, and damages (actual and consequential) of any kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising from or in any way related to such dispute. Termination Termination by Brotiket These Terms of Use shall apply fully while you use the Brotiket Platform or Services. Brotiket may terminate or suspend your access to the Services or your membership at any time, for any reason, and without notice. This may result in the loss and destruction of all information associated with your membership. Brotiket may also immediately terminate or suspend all Services and access to the Brotiket Platform without notice or obligation if you violate the terms and conditions in these Terms of Use. Impact of Termination Upon termination of your Brotiket Account, your right to use the Services and access the Brotiket Platform and any Content will immediately cease. By nature, all provisions in these Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability. If these Terms of Use are terminated due to your violation, Brotiket has the right to cancel any active vouchers that you may have purchased prior to the termination. Brotiket is not obligated to refund any money or be held responsible to you. Passport, Visa, Documentation, Licenses, & Insurance Your Responsibility All passengers, regardless of nationality and destination, are required to research the latest entry requirements from the consulate of the country they will be visiting. As visa and health requirements can change without notice, Brotiket recommends that you verify the health and visa requirements with the relevant consulate prior to your departure. You acknowledge that some operators may require you to comply with local policies and provide the necessary documentation and/or license as a prerequisite for using and/or participating in the services they offer. Brotiket strongly recommends that you purchase comprehensive travel insurance prior to your departure. Governing Law These Terms and Conditions are governed by the law of the Republic of Indonesia Special Administrative Region. You agree to the exclusive jurisdiction of Indonesian courts. Others Severability If any provision of these Terms of Use is deemed to be unenforceable or invalid, such provision will be limited or eliminated to the minimum extent necessary so that these Terms of Use remain enforceable and fully valid. Transferability These Terms of Use cannot be transferred, assigned, or sublicensed by you without prior written consent from Brotiket. Brotiket may transfer, assign, or delegate these Terms of Use and its rights and obligations without prior notice to you. These Terms of Use are written and construed in Indonesian language. Any translation of these Terms of Use is for reference only. In the event of any discrepancy between the Indonesian version and a translated version, the Indonesian version shall always govern.
